Blue Freedom Memberships
Scope of service
Insofar as a contract has been concluded for a service package subject to cost, Leanne Bird Wellbeing & Adventure shall provide the agreed services. Where Leanne Bird Wellbeing & Adventure provides contents and/or services beyond this on a voluntary basis, this will be done without assumption of any legal obligation to do so and Leanne Bird Wellbeing & Adventure shall be entitled to modify, expand or limit these services at any time.
Leanne Bird Wellbeing & Adventure does not undertake to make data backups for the User and does not extend any assurances, guarantees or warranties beyond the legal regulations, unless agreed otherwise in the individual case.
You need to be aged 18 or over in order to become an member and access member services.
Leanne Bird Wellbeing & Adventure is free to unilaterally change the membership terms and conditions without giving further notice to the individual members. Such changes will, unless otherwise stated, take immediate effect. Leanne Bird Wellbeing & Adventure will publish any changes to the terms and conditions on its website. However, members are responsible for keeping themselves update in relation to these behaviours.

User’s Duties and Obligations, Prohibited Behaviour
You undertake to provide information truthfully and completely and to keep this information up to date during the term of the contract by adjusting the information or notifying Leanne Bird Wellbeing & Adventure.
Only one registration may be maintained per person.
You are obligated to keep your login data secret and not to pass it on to third parties. It is prohibited to provide third parties a possibility to use the registration and/or a service package.
You acknowledge and agree that Leanne Bird Wellbeing & Adventure’s name, services, and any logos, designs, text, graphics, software, content, files, materials and any other intellectual property rights contained therein, including without limitation, any copyrights, patents, trademarks, propriety or other rights arising thereof, are owned by Leanne Bird Wellbeing & Adventure or its affiliates, licensors or suppliers.
You may not reproduce, disseminate or make these contents publicly accessible or remove any technical protection measures or copyright markings or rights symbols, unless this is expressly permitted.
You may use Leanne Bird Wellbeing & Adventure’s offer exclusively for your private purposes. Commercial or business use is prohibited.
You must use these services in agreement with the Health Commitment Statement.
Third-party services
Certain membership services may integrate, be integrated into, or be provided in connection with third-party websites, services, content and/or materials. Leanne Bird Wellbeing & Adventure does not control third-party services. Leanne Bird Wellbeing & Adventure makes no claim or representation regarding the Third-Party Services and accepts no responsibility for the quality, content, nature or reliability of third party services. There is no implied affiliation, endorsement, or adoption by Leanne Bird Wellbeing & Adventure of these Third-Party Services and Leanne Bird Wellbeing & Adventure shall not be responsible for any content provided on or through these Third- Party Services.
Period of Commitment
You are agreeing to subscribe monthly or annually for the services provided by Leanne Bird Wellbeing & Adventure and contracting to remain a subscriber for the minimum period of the contract (“Minimum Period”).
‘Minimum period’ for monthly online membership is 6 month.
‘Minimum period’ for annual club membership is 12 months.
‘Minimum period’ for other subscriptions is as described upon sign up.
Paid membership subscriptions:
Once you have completed the minimum number of PayPal Subscription payments we will automatically continue to collect the agreed PayPal Subscription payment amount each month. Your contract will continue until terminated in accordance with these provisions.
If payment in one complete sum for a certain period has been agreed, the total sum shall be due in the beginning of the period, unless agreed otherwise. For the rest, the agreed fees shall be due immediately, unless agreed otherwise.
You may cancel the automatic renewal of this contract at any time by providing at least 1 month notice by e-mail to Leanne Bird Wellbeing & Adventure (contact@leannebird.co.uk).
Termination of service, limited rights to cancel
During the Minimum Period you may cancel the contract only:
- If we fail to maintain the standard of service you would reasonably expect.
- If we alter the operating hours of the services unreasonably resulting in you being subsequently being unable to access the services.
- If you develop a medical condition which prevents you from using the services on an ongoing basis. An appropriate medical practitioner must provide written evidence that this is so.
- If you move away from the area by a distance which we consider, at our sole discretion, to be too far to travel to the services for regular use. We shall require evidence that such a move has taken place.
- If you lose your employment and are subsequently unable to keep up your repayments under this contract. You must produce documentary evidence and we may, at our discretion, suspend your payments for two months. We will then review your financial situation with you.
- If you become pregnant. You must produce documentary evidence and we may, at our discretion, suspend payments for three months. We will then review your situation with you.
In any of these cases above, at the discretion of Leanne Bird Wellbeing & Adventure, if owed, you will be receive the return of a pro ratered payment minus a £15 administration fee.
Missed payments
If you miss a payment, you will be deemed to have breached your contract. If you miss one payment you will need to contact Leanne Bird Wellbeing & Adventure to reactivate your account.
Giving notice to cancel
Leanne Bird Wellbeing & Adventure will continue to collect your monthly subscription after the Minimum Period via PayPal Subscription. If you wish to cancel the contract at any time after the Minimum Period, you must give at least 1 calendar months’ notice. The notice should be in writing or by e-mail (contact@leannebird.co.uk) and sent to Leanne Bird Wellbeing & Adventure.
Collecting subscriptions
Subscriptions are made via PayPals subscription service.
If you fail to make a payment on time, you will incur the following charges:
- Fail to pay the subscription on the due date £15.00.
- Fail to pay the missed subscription within 7 days of the date of a reminder correspondence £30.00.
- Fail to pay the arrears and accrued charges within 7 days of the date of a Final Notice £45.00.
Late payment charges become payable immediately when they are incurred.
Other Charges include:
- Payment other than by Paypal Subscription £15.00.

Please keep in mind that all opinions are solely that of www.leannebird.co.uk & Leanne Bird t/a Leanne Bird Wellbeing & Adventure. And that while I have extensive experience as a fitness, wellbeing & adventure professional, I am not a physician, nutritionist or registered dietitian.
All information is intended for your general knowledge and is not for intended for use if you are a minor, are pregnant or have any type of health condition unless prior discussion with myself.

As with all exercise programs, when using our exercise videos, you need to use common sense. Please ensure you are in a safe area and have completed your own risk assessment of your chosen area. The environment is safe, you have enough space to move freely without obstacles, obstructions or other hazards, and ensure that any equipment is safe and in suitable condition.
To reduce and avoid injury, you will want to check with your doctor before beginning any fitness program. You understand that it is your responsibility to consult with your doctor prior to any online classes regarding any health conditions and existing or pre-existing injuries or the impact of changes in diet on pre-existing diseases or medication or lifestyle.
By performing any fitness exercises (including yoga), you are performing them at your own risk. www.leannebird.co.uk & Leanne Bird T/A Leanne Bird Wellbeing & Adventure will not be responsible or liable for any injury or harm you sustain as a result of our fitness program, online fitness videos, or information shared on our website. This includes emails, videos and text.
Children/minors participating, should be supervised at all periods and throughout the online fitness session by an adult.
You represent and warrant that you are physically fit and have no medical condition that would prevent your full participation in our fitness program, online fitness videos, or information shared on our website. This includes emails, videos and text.
You agree to take full responsibility for any risks, injuries, damages, unknown or known, which you may incur and expressly waive any claim you may have as a result of participating in our fitness program, online fitness videos, or information shared on our website. This includes emails, videos and text.
You have updated your physical activity readiness questionnaire (par-q) and confirm you have made your instructor aware of any new conditions.
You also confirm the following:
You understand that it is your responsibility to ensure your internet connection is working before, during and after any live online class provided by Leanne Bird Wellbeing & Adventure.
You will not share your account credentials or give others access to your account.
You understand and agree that no refunds are given for any online classes provided through Leanne Bird Wellbeing & Adventure.
You understand that the purpose of the wellbeing and exercise programme is to provide safe and individualised exercise and activities to improve physical and mental health, wellbeing and fitness. Exercises/activities may include:
- cardiovascular exercises – walking, jogging, skipping, stair climbing, surfing, paddle-boarding, cv machines and other such activities.
- resistance training – free weights, body weight, circuits and other activities to increase muscular strength or endurance.
- flexibility exercises to improve movement around the joints and range of motion.
- mental wellbeing activities such as yoga, relaxation and meditation
By paying for membership / classes or clicking on free or paid content you agree you have read the above release and waiver of liability and fully understand its contents. You voluntarily agree to the terms and conditions stated above.
In person sessions
In the following Terms and Conditions “The Client” means each group member, individual or their respective parents, and “we, our, us, ourselves” means Leanne Bird Wellbeing & Adventure and any associated staff.
Making a booking
A booking will be confirmed upon receipt of a full payment (unless another specific arrangement has been agreed in writing).
Payment
Full payment is required at the time of booking. Payment is made through the online booking system, or can be made in the form of bank transfer via an invoice. Cash, cheque or credit/debit card (via invoice) may be accepted by prior arrangement at our discretion. Any payment made electronically or by telephone confirms acceptance of Leanne Bird Wellbeing & Adventure’s terms & conditions.
Cancellations by you
In the event that The Client cancels the Activity session or fails to attend / members of their party (after final confirmed numbers) fail to attend, the session on the Session Date, for any reason including unforeseen illness or infirmity, Leanne Bird Wellbeing & Adventure will suffer losses. As such, The Client agrees that in the event of cancellation by the customer or members of their party fail to attend, the following shall be forfeited by The Client and paid to Leanne Bird Wellbeing & Adventure as liquidated damages and not as a penalty.
We advise clients to take out appropriate insurance that covers cancellation, personal injury and property.
No-shows will be charged the full price.
Changes by us
We reserve the right to make changes at any time to the session and services we provide which become necessary due to circumstances beyond our control, in order to maintain the safety of you, The Client, and our staff. For example: if the sea is if the sea is too rough to safely go ahead with paddle boarding on the sea, it will be replaced by an inland session.
Cancellation by us
In the event of cancellation by us for reasons other than weather or safety, we will firstly offer an alternative package or date and if unacceptable to the client, we will refund full payment.
No refund is offered if the client refuses to comply with Leanne Bird Wellbeing & Adventure policies and the Instructor determines the client cannot participate in the activity (e.g. client is under the influence of drugs or alcohol).
If the client advises the Instructor of a medical condition such that the Instructor decides that it would be unsafe for the client to participate in the activity, a full refund will be offered.
If the Instructor becomes aware of a client’s medical condition after the lesson has commenced, such that the Instructor determines it is unsafe for the client to continue in the activity, no refund will be offered.
Price Changes
The tariffs printed on this website/form are valid at the time of publication. Leanne Bird Wellbeing & Adventure reserves the right to increase or reduce any of these prices any time after publication. Any changes will be made clear at the time of booking.
Weather
We reserve the right to alter the session’s content and use different venues in order to maintain the safety of you, The Client, and our staff. In the event of us being unable to deliver a session we will provide the client with an alternative date or a credit note to the full value of the cancelled services.
If water and weather conditions become unsafe during the activity, the instructor may modify the activity and undertake activities on the shore rather than in the water, or the activity may be rescheduled for another time.
If the client has paid for a block of lessons at a discounted price, a credit will be given for the lesson within that block at the discounted price.
Gift Vouchers
Gift vouchers are to be paid for in full at time of purchase. Gift vouchers expire one year from the date of purchase. Gift vouchers can not be redeemed for cash value.
Insurance & Liability
Leanne Bird Wellbeing & Adventure has a comprehensive public liability policy with an Indemnity/Benefit limit of £10 million. We are happy to provide a copy of our certificate should you need one.
Bookings with Leanne Bird Wellbeing & Adventure DO NOT include travel or personal injury insurance. Please ask your insurer for details of the necessary cover for taking part in Leanne Bird Wellbeing & Adventure activities.
Client Safety
The Client will at all times during the course, in the interest of safety, promptly comply with all reasonable instructions or advice given to him by us. If the client fails to comply with such instructions or advice, we reserve the right to exclude the client from the session and do not accept any responsibility for any liability, loss expenses or damages arising because of the client’s failure to comply. Any monies paid by the client are not returnable.
Nuisance and Abusive Clients
We reserve the right to exclude a client from a session if we believe the client to be causing a nuisance or to be abusive to the staff and other clients on the activity. We do not accept any responsibility for any liability, loss expenses or damages arising from the nuisance or abusive behaviour of the client. Any monies paid by the client are not returnable.
Alcohol & Drugs
Alcohol must not be consumed before the commencement of activities, during activities or during any breaks in the day’s activities. We reserve the right to exclude the client from any services provided by ourselves if we feel the client is unfit to participate in the service on offer.
Client Fitness
All clients must make us aware of any medical conditions, illnesses or allergies they may have and any prescribed medication they are taking prior to commencement of the activity by completing a medical declaration. It is the responsibility of the participant with a medical condition to check with his or her GP to find out if the activities they will be participating in are within the customer’s physical and/or mental parameters. If the participant is unsure if they are sufficiently well, fit or able for the activity, they are to contact us prior to the day of the activity. If the client, in our opinion, on the day of the activity, is not considered to be sufficiently well, fit or able for the session in the interest of safety we reserve the right to exclude the Client from the session at any time, either before or during the session, in which case it is agreed there shall be no liability to us for any damages, loss or expense and any monies paid by the Client are not refundable.
Client Belongings
We do not accept any responsibility of any kind for the client’s property of any description, including monies, luggage, baggage and vehicle. Property must in all circumstances be the sole responsibility of the client. Leanne Bird Wellbeing & Adventure take no responsibility for client’s keys or other belongings stored in Leanne Bird Wellbeing & Adventure vehicles while on activity, such items are left at the client’s risk.
Leanne Bird Wellbeing & Adventure Equipment
Where it is including in your booking, Client’s will have the use of Leanne Bird Wellbeing & Adventure’s equipment during their sessions. Whereas Leanne Bird Wellbeing & Adventure takes all reasonable measures to ensure the safety and good condition of that equipment, clients are responsible for immediately reporting any damage caused to the equipment or which becomes apparent whilst the equipment is in their possession.
Supervision of minors
All children under the age of 18 must be accompanied by a parent or legal guardian on the activity. In most circumstances, children must be 12 or over to participate, however please check booking terms for your specific activity at the time of booking.
